Terms of Service

Preamble

These Terms of Service (“ToS”) govern the use of the HelloRento platform (“the Platform”), published by [COMPANY NAME TO BE COMPLETED]. By using the Platform, you fully accept these ToS. If you do not accept these terms, please do not use the Platform.

Article 1 – Purpose

HelloRento is a SaaS (Software as a Service) platform for landlords and tenants to manage rental properties, including:

  • Property management (flats, houses, commercial spaces)
  • Tenant management (individuals and companies)
  • Creation and management of tenancy agreements
  • Move-in and move-out property inspections
  • Rent receipt generation
  • Annual rent review (RPI/CPI)
  • Document management
  • Electronic document signing

Article 2 – Access to the Platform

Access to the Platform is open to two categories of users:

2.1 Landlords

Property owners, letting agents, and property management companies, whether individuals or professionals.

2.2 Tenants

Tenants invited by landlords to access their rental documents, property inspections, rent receipts and tenancy agreements.

Registration requires the creation of an account with a valid email address. Tenants access the platform via an email invitation system.

Article 3 – User Account

3.1 Account creation

To access the Platform, users must create an account providing accurate and up-to-date information. Users undertake to maintain the confidentiality of their login credentials.

3.2 Responsibility

Each user is responsible for the use made of their account. Any fraudulent use must be reported immediately to HelloRento.

3.3 Suspension

HelloRento may suspend or terminate an account in the event of non-compliance with these ToS or fraudulent use of the Platform.

Article 4 – Data Protection

HelloRento is committed to protecting personal data in accordance with the UK GDPR and Data Protection Act 2018. Data is hosted on secure servers and protected by Row Level Security (RLS).

Rental documents (agreements, inspections, receipts) are retained for 6 years from end of tenancy, in accordance with the Limitation Act 1980.

Article 5 – Intellectual Property

The Platform and all its content (text, images, logos, source code, etc.) are the exclusive property of HelloRento and are protected by intellectual property law.

Any unauthorised reproduction, representation, modification or exploitation of all or part of the Platform is prohibited.

Article 6 – User Obligations

Users undertake to:

  • Use the Platform as intended and in accordance with these ToS
  • Not infringe the rights of third parties
  • Respect tenant data confidentiality and privacy
  • Not attempt to access parts of the Platform to which they are not authorised
  • Not use the Platform for illegal or fraudulent purposes
  • Keep their account and property information up to date
  • Comply with UK tenancy law and relevant housing legislation
  • Provide accurate and complete information about properties and tenants
  • Inform tenants of their rights and obligations

Article 7 – Regulatory Compliance

7.1 UK Housing Act

The Platform incorporates obligations from the UK Housing Act 1988 and Landlord and Tenant Act 1985, including mandatory documentation and regulatory tenancy templates.

7.2 Rent Review

Rent review calculations follow the RPI/CPI index published by the ONS (Office for National Statistics).

7.3 Electronic Signatures

Electronic signatures have the same legal validity as handwritten signatures under the Electronic Communications Act 2000.

Article 8 – Limitation of Liability

HelloRento endeavours to ensure platform availability and security but cannot guarantee uninterrupted service.

HelloRento shall not be liable for direct or indirect damages resulting from the use or inability to use the Platform, except in cases of gross negligence or fraud.

Users are responsible for compliance with their tenancy law obligations. It is the responsibility of each user to verify that their actions comply with applicable legislation.

Article 9 – Modifications

HelloRento may modify these ToS at any time. Users will be notified of significant changes. Continued use of the Platform following any modification constitutes acceptance of the updated ToS.

Article 10 – Governing Law

These ToS are governed by English law.

In the event of a dispute, the parties shall first seek an amicable resolution. Failing that, any dispute relating to the interpretation or performance of these ToS shall be submitted to the courts of England and Wales.
